Why US providers remain a risk

Many large US software vendors and hyperscalers actively promote their „GDPR compliance“ and refer to their own server locations in Europe. However, regarding data sovereignty there is a decisive legal difference:
Even if US companies use European servers, they inevitably remain subject to US legislation as a US corporation. Specifically, this means that US authorities, through laws such as the US CLOUD Act or FISA 702 can demand access to customer data – even if they are physically located in the EU. While the current EU-US Data Privacy Framework is intended to facilitate transatlantic data exchange, it still does not provide a watertight protection for highly sensitive business and government data against potential access.
